BISON-M DISCLAIMER POLICY

Thank you for visiting the New Mexico Department of Game and Fish's (NMDGF’s) website and reviewing our Disclaimer Policy. The Department has a Privacy Policy that is also available on this website. By visiting this website, you are accepting the policies and practices described in this Disclaimer. Please note that this Disclaimer is subject to change without notice.

  Disclaimer of Liability

The New Mexico Department of Game and Fish (NMDGF) shall not be held liable for any improper or incorrect use of the information contained on the BISON-M website and assumes no responsibility for the use of this information. In no event shall NMDGF be liable for any direct, indirect, or incidental damages arising in any way out of the use of this website. These data have been processed successfully on computers of NMDGF and no warranty, expressed or implied, is made by NMDGF regarding the use of these data on any other system, nor does the fact of distribution constitute or imply any such warranty. In no event shall NMDGF have any liability whatsoever for payment of any consequential, incidental, indirect, special, or tort damages of any kind, including, but not limited to, any loss of profits arising out of use of or reliance on the biological data provided on BISON-M or arising out of the use of, or file download(s) from, the website. This disclaimer of liability applies to any damages or injury, including but not limited to those caused by any failure of performance, error, omission, defect, delay in operation or transmission, computer virus, or alteration or use of record on BISON-M.

One who uses information available for use on this web site assumes the risk of using or relying on information contained herein.

  Disclaimer of Accuracy of Data

While NMDGF attempts to provide the most accurate information possible, these biological data are provided "as is" and NMDGF makes no guarantee or warranty concerning the accuracy, adequacy, completeness, reliability, or usefulness of any information contained in BISON-M. NMDGF further makes no warranties, either expressed or implied, as to any other matter whatsoever, including, without limitation, the condition of the product, or its fitness for any particular purpose. The burden for determining fitness for use lies entirely with the user. Information in BISON-M comes from a variety of different sources, with varying levels of certainty. For example, county occurrences may be based upon specimen records from within the county, reports that appear reliable but are not confirmed with physical evidence, or inferred occurrences based upon observations from adjacent and similar areas. Users should review the sources of data for BISON-M. These can be found by clicking on the blue number that follows each specific piece of information presented within BISON-M and jumping to the full citation for the references of interest.

Information is added and changed periodically, and data may become out-of-date quickly. It is recommended that the user not let a significant period of time elapse between obtaining and using information from BISON-M. NMDGF denies responsibility for the conduct of users of BISON-M.

  Disclaimer of Applicability of Data

The BISON-M website is constantly being updated and expanded. Information contained on the BISON-M website does not constitute an official opinion by the NMDGF, nor will it, by itself, meet any regulatory requirements. The information in BISON-M does not replace the need for conducting field work. The information must be used in consultation with appropriate federal, state, and local officials. The absence of data confirming the occurrence of a species within a geographic area in BISON-M does not constitute a definitive declaration that the species does not occur in that geographic area.

  Disclaimer of Spatial Habitat Information

Maps of modeled habitat distributions are provided for many vertebrate species courtesy of the Gap Analysis Project. These models represent the spatial distribution of areas suitable for species occupation within a species’ range. Species range is defined as the geographic limits within which a species can be found. Models are based on habitat associations from published literature and spatial environmental datasets, including elevation and land cover. Animal habitat modeling maps should not be used in place of site-specific determinations of species occurrence, including field surveys.
